Letter from Lorance, vicar apostolic, to PF. Lorance wants to express his gratitude and consolation that was within the letter sent by PF on 12 December last year. This should have ended the problems with the Trinitarians and the English consul, however this is unfortunately not the case. When the discalzed Trinitarians arrived on 21 March, they publicly announced in the presence of the divan that it was false, and made up by Lorance. They also stated that they had never heard of Cardinal Altieri [Paluzio Altieri, the PF prefect], PF, Father Ferdinando d'Alva, the pope, or the vicar; they had only heard of Divan d'Algery. This led to the rejection of his request by the Dey, to detain money from the alms to pay for the debts of Sig'r Gianola [Giuseppa Giannola?]. At least 4,000 piastre are in the hands of the Trinitarians, but are meant for this purpose. The Trinitarians and the English consul gave gifts to the Dey, for which they now receive help in return. The Trinitarians also have Trinitarians passports, and the money was actually meant for the ransoming of slaves. PF still allows the collected alms to be used to pay for the debts of Giannola. Lorance wants PF to give him a letter that will protect him against the Divan, and he wants the Trinitarians to pay the 4,000 piastre. It is also important that PF confirms the authority of the vicar over the Trintarians; the discalzed Trinitarians staying in Algiers claim that they can errect altars in the houses they are staying in, celebrate mass, confess, and do all the functions independently from the vicar and bishop, in every part of Christendom. Dominico Lassari (the nephew of the pope), has finally been ransomed for 800 piastre da otto reali; 260 had been paid by bis brother and the pope, 30 by the Discalzed Trinitarians, and the rest 200 scudi came from the alms of the Trinitarians. He has included a letter by the same Lassari.

Letter from Lorence, vicar apostolic, to PF. Last September Lorence sent two priests away. One of them is member of the Trinitarian order, and is named Gioan Antonio Vello. He had been the administrator of the hospital for nine years. At the end of his time, he had aquired a debt of 40,000 otto reali, though there were not any specific reasons for such spending; the only reason seems to be that he was involved in commerce. In Spain there is a priest of the same order, who paid a big part of the debts of Vello, through his fortune aquired in the wool industry. After this, Vello was sent to Spain. He later returned to Algiers were he organized great banquets for his friends, which caused a big scandal. The other priest is a certain Giovanni di Santa Maria, a Minor Observant. He once released 38 Portuguese, five of whom died, and the others left together with Giovanni to Livorno, on 23 November of this year. This all happened thanks to the king of Portugal who gave Lorence and the English consul 12,968 pezze da otto. Giovanni had debts for around 3,000, but they paid some creditors so that he and the freed slaves could leave. However, both Giovanni and Vello lived scandalous lives, and tried to take possessions from the slaves. Lorence asks PF to impede their return, and to write to the king of Portugal. There are still 11 Algerian vessels that raid other ships, and most raids happen on the oceans, and not in the Mediterranean.

The letter begins with a list of 19 subjects from the papal states, that are slaves in Algiers. Because nobody is trying to free them, there are many subjects of the pope still in slavery in Tunis. They do not profit from the services of the orders of redemption. This could be solved easily by writing to the bishops of the four provinces of the papal states. They should ask them to elect the most capable persons to collect alms, that can contribute in the freeing of the subjects.

The Trinitarian procurator states that his order always has mantained hospitals in Algiers, founded at their own expense. From the Holy See they received privileges to find churches and administer the sacraments. They had been doing this for 16 years, when Gio Levacher [Jean Le Vacher] the vicar apostolic, wanted to change the title of the Church of the Holy Trinity to S. Louis; he also wanted to change the name of S. John of Malta to S. Roch. Because the priests protested against this, Le Vacher decided to remove the cross that was painted on the main altar, and the arms of the king of Spain on the door outside. Moreover, he also wanted to take the Holy sacrament from the churches. They ask PF not to harass the Trinitarian priests, and not to change their privileges because of the following problems: a) the hospitals are in the bagnos whose doors close at midnight, and it might be that during the night one of the patients needs the viaticum; b) the slaves want to confess and receive the eucharist, before going to the houses of their masters; c) there are 10,000 slaves, and in the chapel of the vicar there is only room for 12 people; d) during the day when the vicar is not at home the viaticum might be needed; and e) there could occur an incident with the sacrament, when bringing it from the house of the vicar, to the hospital. The Trinitarian Fathers base their priviliges on a breve from Clemens VIII of 31 August 1596, of Paul V of 8 February 1608 and on a confirmation of Pope [Innocens XII] of 27 June 1693. The first two popes gave the priests faculties for ten years. From Paul V onwards however they are without an extention, and not contain the privilege for celebrating mass twice a day. The breve of the pope gives the priests some faculties, but limits them by stating that they may not be contrary to the Holy canonics, and to the decrees of the council of Trento; according to the council, they should be submitted to the jurisdiction of the vicar apostolic. Moreover, when Clemens VIII and Paul V granted the faculties, they added a clause that shows that they did not want to undermine the ordinary authority. PF secretary adds that on 9 September 1652 they decided that Gio' Leuacher [Jean Le Vacher] could submit everyone (priests or captives) to his authority, with the faculty to punish them if necessary, in order to remove the abuses from the city of Tunis. [Philippe Le Vacher] then on 28 June 1660 reported the scandals commited by many priests (both slaves and free), pretending not to be submitted to his authority. That is why the vicar in Algiers, got the same faculties as those in Tunis. This was not yet enough to settle the conflict against the Trinitarians. On 28 February 1673 it was necessary to forbid the priests for some time (in particular one of the administrators Bartolomeo Da Serrano), to use the sacraments without the license of the vicar. Eventually Bartolomeo was recalled from Algiers. On 11 September 1679 the Trinitarians complained that first of all, the vicar apostolic [Jean Le Vacher] took their coat of arms from the hospital. Secondly, he forbade them to keep the Holy sacrament and thirdly, he forced them to accept heretic patients in the hospitals. For the first it was decided that the vicar should not do this again. For the third it was decided that the heretic patients should be kept apart from the Catholics. For the second PF wanted to know why the vicar decided to forbid this. PF forbade the Trinitarians, administrators, or any other priests of this order, to stay or exercise jurisdiction in that city without the permission of the vicar apostolic. On 3 February 1688 it was written to the Trinitarian superiors and the nuncio to Spain, that whilst the vicar had suspended some priests, the Father Antonio d'Espinosa (administrator of the hospital), had given the Trinitarians permission to celebrate mass in his chapel, and administer the sacraments. One of the priests was questioned about this, and said that he was free and not dependent on anyone. He said that the priests had their own privileges and could do whatever they wanted. The new vicar apostolic, D. Lorenzo, reported the same complaints against the Trinitariansto PF. The order however kept persisting in their independency from the vicar. The vicar consequently asked for a decree, ordering that the Trinitarians would be subjected to his authority despite their privileges. On 11 May [1644?] it was decided to renew this decree. After this, the Trinitarians sent letters to PF complaining about the new decree.

Petition on behalf of several priests of Calvaire, Bétharram, in the diocese of Lescar, requesting permission to establish a congregation of 24 priests under the title of the Blessed Virgin of the Mount Calvary. 15 years ago a miraculous image of the Virgin was discovered at the foot of the mountain of Bétharram, and since then so many pilgrims have visited, that with their donations a church and hostel (for pilgrims) was built, as well as houses for the priests. The congregation of secular priests was established by the bishop, with the approval of the king under the name of Mount Calvary of Bétharram. They are also asking for permission to celebrate mass one hour before daybreak and one hour after midday, and to also solicit charity donations throughout the kingdom without being molested. The petition is undated and unsigned.

Cardinal Spada informs PF that the archbishop of Paris is heir (but not beneficiary) of the late Cardinal de Retz, and that he could perhaps be "lured" to pay the fee for his late brother's cardinal ring (which had not been paid) by way of a brief from the pope, which would do him honor, especially since he (the archbishop) seems well disposed toward "Rome." The note on the back indicates that PF did not deem a brief appropriate, but instead charged Cardinal Bentivoglio to send the archbishop a letter to this effect, and entreated Cardinal Spada to also work himself on convincing the archbishop, considering that he (Cardinal Spada) had had great success in convincing another French cardinal to pay the fee for his ring (i.e. Cardinal de Sourdis). Cardinal Spada was also asked to remind Cardinal de La Valette to honor his promise to pay his fee as well, if he wants to please PF, following the example of other French cardinals who paid their own. The second part of the letter/note refers to Gabriel Sionita's planned travel to Rome and request for supporting funds (granted by PF only to a max. of 100 scudi).

a) Cardinal Spada was leaving the French nunciature that year. b) Other cardinals who had not paid for their rings according to the "constitution" of Pope Gregory XV are mentioned in other documents, together with the nuncio's efforts to extract the money. See for instance "Cardinale della Cueua" in SOCG 129, f. 3-3v/note6v (letter by the nuncio from Paris, 15 April 1627). Josef Metzler discusses the matter in "Foundation of the Congregation 'de Propaganda Fide' by Gregory XV," in J. Metzler, ed., Sacrae Congregationis de Propaganda Fide Memoria Rerum, vol. I/1 (Herder: Rome, Freiburg, Vienna, 1972), 79-111, here 99-100. Metzler notes that "most of the Italian Cardinals were prompt in making their offering" but that there were difficulties with the French. Metzler mentions that Cardinal Richelieu and Cardinal de Sourdis eventually paid at the end of 1624, and de Sourdis even paid double, i.e. 1,000 scudi. For these cases, Metzler cites APF Lettere vol. 2 (1622-1623), f. 29v, 49r, and 64r-v. NB: The "constitution" of Gregory XV (1622) established that the fees traditionally paid by the heirs of the deceased cardinals for their cardinal rings be turned over to PF; a later decision by PF (same year) stated that current cardinals should feel free to make their payment in advance in order to support PF; and that, in the future, newly created cardinals would have to pay their fee to the PF on the day they were appointed (Metzler cites APF Acta vol. 3 (1622-1625) f. 5v-6r).

The PF general meetingwas held in the Vatican, in the presence of the pope. Seven cardinals and three clerks were present: "Bandinus, Millinus, Borgia, Bentiuolus, Ludouisius, Magalottus et Barbarinus, et R'mi Sanctacrucius, et Montius, et P'r D'nicus à Scala, qui attulit scuta 250. Sac. Cong'ni donata." (f. 184r).

Letter from PF to Cardinal Spada, letting him know that the cardinals of PF do not think it is a good idea that the pope write a letter to the archbishop of Paris asking him to pay the cardinal ring fee. Instead, PF asks Cardinal Bentivogli to write the archbishop an "effective" letter, hoping that it would produce the desired results, together with the efforts of Cardinal Spada himself, especially considering the success that he [Cardinal Spada] had had with Cardinal de Sourdis on a similar matter. PF also asks Cardinal Spada to remind Cardinal de La Valette about his promise to pay for his own cardinal ring, and about the fact that many other French cardinals have already paid their dues. The second part of letter refers to Gabriel Sionita.

Letter from PF to the nuncio to France, Giovanni Francesco Guidi di Bagno, letting him know about the response of the archbishop of Paris to Cardinal Bentivoglio (attached on a separate paper and filed not in this volume, but in the SOCG collection), regarding the cardinal ring fee issue. PF, in the presence of the pope, decided to write the following to the nuncio: a) that the archbishop's argument that the late Cardinal de Retz was not supposed to pay the cardinal ring fee is not valid, because Cardinals Gusman of Spain and Richelieu of France paid it, even though they had not received the capello (the cardinal hat); b) the nuncio should try to see if the ring fee could be obtained from the owners of the late Cardinal de Retz's property, since the archbishop and the other relatives are excusing themselves by saying that they are not his heirs. Prehaps in this manner, they would have decide to pay it.

The new nuncio to France, Giovanni Francesco Guidi di Bagno, lets PF know that the solution suggested by PF in a letter from 20 May 1627, namely to collect the fee for the ring of late Cardinal de Retz via litigation with the owners of his goods, would be too difficult and costly. Instead, he tried to convince the archbishop of Paris to pay the fee out of "liberality" and for the sake of the pope and PF. The archbishop promissed to do so, but with a delay of "several months." The nuncio accepted the promise without rushing the archbishop to fulfill it by the time of the following PF general meeting; the nuncio is going to follow up with the archbishop in order to make sure that he pays the fee.

Latin translation of a notarized compilation of two earlier documents in French, namely the CM foundation act (17 April 1625) and its approval by the archbishop of Paris (24 April 1626). The French notarized version (dated 12 August 1627) was sent to PF with the aim of having CM approved; the Latin translation was done at the request of PF, probably by a PF translator (see the PF note to the nuncio's letter in support of CM from 26 September 1627, on f. 122v (database item 22).

The general of the triremes (Philippe-Emmanuel de Gondi) asks Cardinal Spada to obtain a brief from the pope ordering the superior of the Capuchins of Provence to send thirteen priests "to instruct, hear confessions and teach the catechism to the captains, soldiers and sailors of said triremes," in Tollon as well as in other places where the triremes would go. The Fathers have been doing their mission on the triremes for one or two years already and they say they cannot continue to do so without a brief. The PF notes on f. 140v indicate that Ingoli was going to discuss the matter with Barberini, and that there was a negative response to the request, given in June 1627.

As noted by Coppo, an additional "memoriale" was probably attached to this petition, which detailed the faculties requested for the missionaries ("infrascritte"); the "joined memo" is also noted on 374v. That document is missing. Coppo argues that it is very unlikely that the said "memoriale" was the 1625 founding contract of CM or the act of approval of that contract by the archbishop of Paris. a) The document was written between the dates of database items 1 and 2; based on its content, it was most likely written between April-May 1627; b) this is possibly the missing attached file to SOCG 129, 10r,16v (database item 2); c) Cardinal Bentivoglio was nuncio to France in 1616-1621; and d) elsewhere it is suggested that Bentivoglio was in Rome at the time.
